Sale of firearms and ammunition

Act No. 190/2003 Coll. on Firearms and Ammunition and on amendments to certain acts

Section 2(1)(g) ammunition means a cartridge or a blank cartridge; an ammunition component is also considered ammunition; (h) ammunition component means a primer, propellant charge or bullet used in firearms; Section 14a A distance contract,15a) whose subject is the purchase and sale of a firearm or ammunition other than a category D firearm, ammunition for a category D firearm, or main parts and components of a category D firearm, may not be concluded, unless this Act provides otherwise.

Distance selling of firearms and ammunition

Pursuant to Section 14a of the Act on Firearms and Ammunition, as amended, a distance contract whose subject is the purchase and sale of a firearm or ammunition may not be concluded, unless the Act provides otherwise.
Pursuant to Section 9 of Act No. 108/2000 Coll. on Consumer Protection in Doorstep Selling and Mail-Order Selling, as amended, a distance contract means a contract concluded between the seller and the consumer for the mail-order sale of goods or the provision of a service at a distance exclusively by means of communication such as, in particular, an addressed letter, addressed printed matter, unaddressed printed matter, an offer catalogue, press advertising with an order form, automated telephone equipment, telephone, videophone, fax, videotex (microcomputer and television screen) with a keyboard or touch screen, radio, television in the case of telephone sales, or electronic mail.
However, pursuant to the amended Section 34(3) of the Act on Firearms and Ammunition, the holder of a firearms licence may conclude a distance contract whose subject is the purchase and sale of a firearm or ammunition, but only with another holder of a firearms licence or another person authorised to purchase and sell firearms and ammunition in the course of their business.
